Procedures for Gated Community Traffic

PROCEDURE FOR OBTAINING TRAFFIC ENFORCEMENT WITHIN A GATED COMMUNITY 

In order for the Port St. Lucie Police Department to provide traffic enforcement services within a gated community, pursuant to Florida Statute Section 316.006(2), the City Council must be willing to enter into a written agreement with the party requesting the enforcement. 

Provisions for reimbursement for actual costs of traffic control and enforcement and for liability insurance by the party or parties may be included in the agreement. All costs associated with the request for these services are the responsibility of the requesting party.

Any proposal for traffic enforcement services must be presented to the Port St. Lucie City Council   for conceptual approval prior to creation of the agreement. The approval of the agreement is subject to satisfactory inspection and final approval of the City Council.

The request should come from the Legal Representative of the entity that has authority to enter into the agreement with the city, as opposed to a resident or occupant of the property.  You will need to contact the City Clerk's office to have the matter placed on the agenda for the City Council's consideration.

If the Council grants conceptual approval, the following steps must be taken prior to the Port St. Lucie Police Department providing traffic enforcement services in private/gated communities:

The Port St. Lucie Police Department must receive a written request for traffic enforcement services, and the request must include a map that specifically outlines the area the party wants to be enforced.

This request must be submitted by the Legal Representative for the property owner/manager or homeowners' association.

The Port St. Lucie Police Department will submit the map and a "Request for Site Visit" memo to the City of Port St. Lucie traffic engineering department.

Traffic Engineering will conduct a site visit within the gated/private community, to ensure compliance with applicable Department of Transportation regulations on signage, speed limits, and road markings.

Traffic Engineering will report back to the property owner/manager or homeowners' association with any deficiencies found at the site, or any required modifications.

Once Traffic Engineering approves the site, the Port St. Lucie Police Department will forward a contract for services to the property manager or homeowners' association.

After the requesting party executes the contract, the contract will be presented to City Council for the adoption of a Resolution.

Once the Resolution is passed and the contract is signed by the Mayor, the Port St. Lucie Police Department will begin providing traffic enforcement services.
