New sign rules to preserve attractiveness, boost local business profits

To help local businesses attract customers, the Port St. Lucie City Council recently lifted restrictions on the use of advertising banners, now allowing them on commercial properties until Jan. 12, 2012. Banners must comply with the city’s sign code in size, appearance and other requirements, and must be professionally made. The change does not allow banners on city-owned rights-of-way, such as roads, shoulders and medians, or on residential properties.

The sign code is available for review at the City Clerk’s office, and on line in Chapter 155 of the City’s Code of Ordinances.

The code defines a banner as any sign, having the characters, letters, illustration, or ornamentations applied to cloth, paper, or fabric of any kind with only such material for foundation. The word banner shall also include pennant or any animated, rotating and/or fluttering device, with or without lettering or design, and manufactured and placed for the purpose of attracting attention.

To display a banner, businesses must have a current city business tax receipt and do not need to apply for a special event application or permit, or pay any application or permit fee.

Additional requirements:

  • Banners must be of free flowing fabric and must be professionally made
  • Banners must not exceed 50 square feet
  • Banners placed on city owned property are subject to being removed by city personnel
  • Only one banner per business may be placed and displayed
  • Banners can be placed only on the private property of the advertised establishment and not on any off-site parcel of land
  • A banner may be placed in the private property landscaping area; however, a banner may not be affixed to the landscaping, such as tied to a tree
  • Banners may not be placed for display on or in any non-moving vehicle
  • Non-permitted structures may not be used to erect banners except for 4” x 4” posts
  • Banners shall not be placed within the “sight triangle” and shall not interfere with vehicular and pedestrian safety.
  • Banners must comply with applicableĀ  property owners association regulations or other authorities which restrict such placement or display based on their own master sign plan programs
  • A flag sign (a piece of fabric with a color or pattern that represents business activity) will be considered a banner
  • All banners must meet all set-back requirements from the city rights-of-way or property lines
  • A banner may be attached to the following existing structures:
  • Monument signs
  • Awnings
  • Poles
  • Fences and gates
  • Buildings
  • Dumpster enclosures
  • Banners may be two-sided
